Dog Bites

What Damages Can I Recover For Dog Bites In Palm Beach County

Dog bites can be dangerous and  traumatic, and more often than not, these bites result in serious medical complications. The most serious dog bite case I have ever handled involved a 2 year old whose face was bitten by a neighbor’s dog.  The child had to undergo multiple surgeries and her face will never look the same again.

Dog bites are not uncommon. Every day across the state of Florida, individuals are bitten by man’s best friend. The most common kind of injuries are lacerations and punctures, which can cause bleeding, contusions, suffering, and scarring. Oftentimes, these wounds can result in physical damage and lead to infections that may include rabies, MRSA, and Pasteurella.  The worst case scenario is permanent physical damage and/or permanent scarring.

According To The Law

Florida statute 767.04 declares that “The owner of any dog that bites any person while such person is on or in a public place, or lawfully on or in a private place, including the property of the owner of the dog, is liable for damages suffered by persons bitten, regardless of the former viciousness of the dog or the owners’ knowledge of such viciousness. However, any negligence on the part of the person bitten that is a proximate cause of the biting incident reduces the liability of the owner of the dog by the percentage that the bitten person’s negligence contributed to the biting incident.” This means that if a judge or a jury finds you, the victim, 60% responsible for the bite, you will be able to only recover 40% of the compensation that you are entitled to receive.

Some animals may seem friendly and adorable but can turn violent without any explanation. Everyone should use precaution and good judgement when dealing with pets, especially the ones you are not familiar with. The Florida Department of Health, the Florida Animal Control Association, and the Florida Veterinary Medical Association have collaborated on encouraging all Floridians to learn how to avoid being bitten by a dog.
